Student Visa To FLR - Financial Requirement

Post by davidjohn » Tue Dec 11, 2012 2:04 pm

Hi All,

My fiance and i would be getting married in Jan 2013. She is currently on a student visa which expires End of August 2013. She has been studying for about 6 years (College, Degree, Masters)

Her last student visa renewal was this year August. She's an international student and her parents are her current sponsor

Since she is on a student visa, We would like to find out the latest date she can submit her application to apply for leave to remain (permission to stay) in the UK as the partner of a person who is present and settled in the UK(British)

She would be submitting the application in person

Thanks

The latest date she can apply is the last day of her current leave.

The title of this topic includes "To ILR", which would not be possible, but your query actually asks about FLR ..... further leave to remain.
We would like to find out the latest date she can submit her application to apply for leave to remain (permission to stay) in the UK as the partner of a person who is present and settled in the UK(British)
The latest date would be the date of expiry of her current visa.

But why wait until that final date? It surely makes sense to apply as soon as possible, not as late as possible.

When would be possible? As soon as the marriage has taken place. Use form FLR(M) to apply for a spouse visa.

Visa application fees highly likely to go up in say April 2013.

My mistake. Yes it's FLR

She is planning to submit the application end of May 2013 because of the documents needed and also looks like she has to take the Life in Uk test

The life in the UK test is for applications for ilr not FLR.

She may need to take an English language test unless she has a degree taught in English or is from a majority English language speaking country.

Would suggest you both read the information available here:

If you are legally employed and NI is deducted from your salary, the fact that your employer has not yet paid passed that to the HMRC is not your problem.

Thanks Lucapooka.

Is the 6 months payslips & bank statements enough to meet the financial requirement since i would not have earned up to 18k by the time she submits the application

The requirement is to have an annual salary at 18.6K, and to have been in that situation for six months. Obviously, you may only have garnered 9.3K (or more or less) of your annual salary at the time she applies but that is fine.
