ILR for PBS dependents - any impact of application date?

Post by ughosal » Wed Dec 12, 2012 11:31 am

Hi,

I have tier-1 general visa expiring 21-Jan-13. My wife and daughter have PBS (t1 Gen) dependent visas valid until same date.

I booked an appointment for ILR premium application in Solihull for 10-Jan-2013. But this appointment is only for me as the web booking site does not show any availability when I include dependents.

Please can anyone guide on whether the rules for ILR for PBS dependents vary depending on:
i) dependents' application is submitted along with main applicant;
ii) dependents apply separately (by post/PEO) AFTER main applicant has got ILR?

In other words, if my wife & daughter submits a postal application for ILR after I have got my ILR on 10-Jan, would they be subject to any rule that is different from if they submitted it with me on 10-Jan at PEO?

Background info:
1. My wife spent time in UK from Oct-2008 to Feb-2011 and since then has been in India on medical grounds, with a valid PBS dependent visa. Will return to UK on 20-Dec-12.
2. My daughter was born in Mar-12 in India and going to arrive in UK first time as PBS dependent on 20-Dec-12. Her PBS dependent visa was applied on 30-Jul-12.

Thanks in advance.
