child born in UK before getting ILR for parents

Post by sujanaik » Wed Dec 12, 2012 7:15 pm

Hi,
I'm right now on tier1 visa (expires on july 2013) and our baby as tier1 dependant born in UK, we are applying ILR next month but not including our baby.
Once we get ILR can we travel to India and come back to UK before july2013, Will the immigration allow the baby to travel with old visa.
Please let me know.
It will take lot of time if we register baby for British citizen, we ant to go before that, is it possible.

You should include the child in your ILR applications or apply for the child to be registered as British after you get ILR, and do either of these before the child tries to re-enter the UK. However, they are not going to refuse entry to a child who is travelling with parents that have ILR. They will wag their finger at you and tell you to take immediate steps to rectify the status of the child.

Hi Lucapooka,
Thanks for the information. To register the baby as British takes 6 weeks. If the baby is registered as British, then he can travel back to UK without British Passport. We cannot apply ILR for him, since he is born here.

What gave you that incorrect idea?
