ICT Long term ,want to know what is the law for resigning

Post by Immi1234 » Thu Dec 13, 2012 3:19 am

Hi All,

I came in UK on ICT Long term, and now for some reason am planning to resign .While going through the offer letter i am confused what is the notice period i should serve in UK ? The offer letter states something like"before the commencement of this secondment and in absence of any other arrangement s you will work with us in India? Does that mean that after I resign I will have to work with the employer in India. I am confused since on the last page it says there is one month of written notice.

Is there a change in notice period after completion of 6 months on ICT long term? like in my case looks like I cannot resign before 6 months.

Please guide

This is more of an employment law matter, it will come down to what it says in your contract - 1 month written notice would be quite common.

The bit about working in India probably refers to your employment for the company overseas before you came to the UK.

Snippet from my contract ,still confused

Thanks for your reply,I am posting a common snippet from my contract ,

We are please to inform that you have been seconded to ABC uk ltd on temp basis on following terms and conditions:
The secondment will commence on 01-Jan-12 for period of 6 months.Early termination of this secondment can be brought about by either party or yourself subject to providing notice period as per your employment contract. On termination of this period of secondment ,in absence of any alternative arrangements, you will continue your service with us in India

Further in the later pages in contract its stated

1.Following successfull completion your of trial period, you will be entitled to receive one month of notice in writing from the company.

2.You will be required to give one month's notice in writing if you wish to terminate your employment.

Does it makes sense,to me, it does not since nowhere the trial period is mentioned. Plus it makes me think that i can resign only after 6 months ,what do you suggest
