New Rules back dated for undecided applicants HC 820

New rules came in yesterday that have been back dated for ALL undecided applications made after the 9th or July the contract of employment and P60 has been dropped as a required document.

2. In respect of salaried employment in the UK, all of the following evidence must be provided:

(a) Wage slips covering:

(i) a period of 6 months prior to the date of application if the applicant has been employed by their current employer for at least 6 months (and where paragraph 13(b) of this Appendix does not apply); or
(ii) any period of salaried employment in the period of 12 months prior to the date of application if the applicant has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a) of this Appendix), or in the financial year(s) relied upon by a self-employed person.

(b) A letter from the employer(s) who issued the wage slips at paragraph 2(a) confirming:

(i) the person's employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

(c) Personal bank statements corresponding to the same period(s) as the wage slips at paragraph 2(a), showing that the salary has been paid into an account in the name of the person or in the name of the person and their partner jointly.

(bb) Wage slips must be:

(i) on company-headed paper; or
(ii) stamped and signed by the employer; or
(iii) accompanied by a letter from the employer, on company-headed paper and signed by a senior manager, confirming that they are authentic.

In the Implementation section of the Statement of Changes in Immigration Rules HC 760, the changes in paragraphs 201, 202, 224, 226 to 228, 242, 243, 276, 339 to 341, 345 to 353, 358 to 361, 370 to 388, 392 to 394, and 399 to 441 of that Statement shall apply to all applications decided on or after 13 December 2012, regardless of the date the application was made."

EXPLANATORY MEMORANDUM TO
THE STATEMENT OF CHANGES IN IMMIGRATION RULES
PRESENTED TO PARLIAMENT ON 12 DECEMBER 2012 (HC 820)


1. This explanatory memorandum has been prepared by the Home Office and is laid
before Parliament by Command of Her Majesty.
2. Purpose of the Instrument
2.1 The purpose of these changes is:
• To apply most of the changes to the Immigration Rules on family and private life
contained in the Statement of Changes in Immigration Rules laid on 22 November
2012 (HC 760) to all applications decided on or after 13 December 2012, rather
than only to applications made on or after that date. This will provide greater
clarity for applicants and for UK Border Agency caseworkers as to the
requirements in respect of family and private life applicable to all applications
decided from 13 December 2012.

In Appendix FM-SE after paragraph 1(b) insert
“(bb) Wage slips must be:
(i) on company-headed paper; or
