I am completing 5 years in Jan-13 on Tier-1 General and applying for ILR.
My wife stayed with me in UK over 2 years initially from 2008 but has been out of UK in the later part of the 5 year period with a valid PBS dependent visa. She is returning to UK before her visa expires. Although the policy allows her to apply for ILR, I am told there could be an element of case-worker discretion.
I also have a daughter born this year in India who is going to arrive first time in UK on PBS dependent visa (applied after 9-Jul-12) before we apply for ILR. I am going to include her in the ILR application as well.
I wish to know, in the worse case that my wife's ILR application (to be made on same form as mine) gets rejected, which is a better option to go for - extension of PBS dependent (t1-general) visa or a FLR(M)? Are there any advantages & disadvantages for these types in my scenario?
