Travel restriction for baby born in UK to parents with ILR?

Post by Davina » Sat Dec 15, 2012 12:00 am

Hi, I was hoping for some advice regarding travel with an infant who was born in the UK, but has not obtained ILR or citizenship for UK.

Myself and my husband have ILR for UK and are Australian citizens. Baby has an Australian passport and we have applied for her to be registered as British.

We want to travel to Australia but are concerned about bringing baby back into the UK on her Australian passport (as I doubt we will have the UK registration certificate back in time to be able to obtain a UK passport for her).

So, can we re-enter her on the Australian passport (and I guess just get a 6 month tourist visa for her till her registration comes back), or should we fork out an extra £1300 for ILR on her Australian passport - even though we currently have the British registration being processed?

Would prefer not to have to pay an extra £1300 for ILR but also don't want to be turned back at immigration and sent back to Australia because she doesn't have a visa!

Many thanks

@Davina,

Congrates for the new arrival.

Your baby can travel back to UK on Australian Passport, there won't be any issues with that, no need to spend another £1300 on premium service.

When did you apply for the registration for your baby as British Citizen?
Information provided is general guidance and does not constitute legal advice.

Was the baby born before or after you/your husband got ilr?

Thank you Spidery_thread. We have only just applied for the British Registration - have had a letter back from them on 12th Dec saying they have received our application so I wouldn't expect to hear again for another 3 months or so (though maybe they are feeling the festive cheer and will just approve it as a Xmas present - one can but dream!)

Greenie - baby was born whilst our ILR was being processed so sadly we couldn't apply for baby's with our application. I swear the stress of completing that SET(O) form brought on labour :shock:
