ICT Tier 2 Short team to long term

I entered UK in April 2012 on ICT Tier-2 short team visa and my visa is going to expire on 30th April 2013. Can i apply for ICT Tier-2 long term visa without serving any cooling period.My company is ready to pay me above 40K.

My company is ready to pay me above 40K. The pay has to be £40 k or the minimum stated for the job SOC code, whichever the higher.
