tricky situation , please advise

Post by mstm » Sun Dec 16, 2012 2:10 am

hi:
I have send my 10 yrs appl to UKBA at the end of Auguest, and my student visa is valid until Oct 2013. However, the college that I am currently studying has strict policy : for foreign student to prove enough progression, we can not fail the same model 3 times.

unfortunately, the exam which I just attended is likely to fail and thats my 3rd time attempt. My question would be if the college report me to UKBA about my insufficient progression, what is gonna happen to my 10 yrs application? Do I need to go back to my home country?

Best Regards

As long as you were living in the UK within the requirements of your Tier 4 leave at the time you submitted the application, what happens after that is not important. It would be important if the ILR application was refused and you then needed to make other applications based on having a valid and current Tier 4 leave.
