T1 UK Visa Change of Circumstance-Didn't inform UKBA in time

Post by blrkunal » Sun Dec 16, 2012 2:51 pm

Dear All,

I got my Tier 1 UK Visa in January 2011. I am due to apply for renewal in 2.5 weeks time, for which I have got an appointment. I mistakenly didn't know that I needed to inform the UKBA about any changes in my circumstances. Since, then a few changes have happened, e.g. (a) I have moved my residence, (b) got a new passport as the old passport got over. (c) my then dependent got her own T2 visa, and unfortunately in the last few months we have separated.

All these changes happened over the last several months. I haven't informed UKBA about it as I didn't know I had to, and thought as long as I am living in the UK legally it should not affect me anyway.

I found out about this just now at the time of making my visa renewal application. What should I do?

Should I immediately inform the UKBA of all the changes using the form provided (and keep a copy of my letter to them)? If UKBA gets back to me in time of my application with their confirmation then its alright. Otherwise, I will go ahead and apply for my Tier 1 anyway and if asked by the case worker, I will show them the copy of my letter to the UKBA (and tell them I am awaiting response).

There are no guidelines regarding how soon one must inform UKBA of any changes. In fact most of the friends I spoke with never informed UKBA of changes (like contact details). And in any case, every time I was traveling outside of the UK, in the landing card - I would write my latest address and use the latest passport. So, indirectly UKBA was always informed anyway.

How does this impact me? Kindly advice as this is confusing me.

Many thanks,
Kunal

You don't need to inform UKBA any of the above mentioned changes.

If there is any change to the circumstances during the period while an applicantion is under consideration, then applicant needs to inform UKBA. There is no requirement to inform UKBA any change of circumstances once a decision has been taken.
