URGENT HELP--Tier 2 General - Change of employment

Post by lrnt » Mon Dec 17, 2012 3:38 pm

Hi,

I have just got a tier 2 general working visa, i haven't entered UK with the Tier 2 visa yet. Currently I got a better job offer and I would like to move to the new firm. The new firm will sponsor me to get a working visa as well.

However, i heard that there is sth called 12 month cooling period for tier 2 visa. Does it apply to my situation?

I guess I need to apply through ' change of employment'? Can I change my employer under a new sponsorship without waiting for the annoying 12 month cooling period?

Or can I have an alternative way: I will start the new job 3 months later and work under a tier 5 visa for 9 months. And after the 12 month cooling period, i can ask the new firm to apply a tier 2 visa?

Or do you have other solutions to my problem?

Thank you very much.

The easiest way in your situation would be to come to the UK under your present visa, start work for the employer who assigned your CoS, then obtain a new unrestricted CoS from the new sponsor and once you have it make a change of employment application from witrhin the UK. However, don't give notice until your application has been approved by UKBA.
