Is Indian passport required when baby is UK Born?

Hello Chaps, appreciate if somebody can provide an useful advise regarding the passport.

I'm Indian origin and living in UK on Tier 1 G since 2007. I'm eligible for ILR in October 2013. My baby girl is born in December 2012. We do not have any travel plans until we get ILR.

My question is:- Do we require Indian passport for the baby until October 2013? Or Can we directly apply for ILR for the baby in October 2013 with out having any indian passport?

Please advise.

Not sure what you meant by ILR for the baby without passport. In case you meant registration as a BC u/s 1(3), then yes, you can and a passport is not required. The only documents required are UK birth certificate and evidence that parent obtained ILR/PR.

On a separate note, if you are living in the UK under Tier 1 General since 2007, why do you need to wait until Oct 2013 for settlement? was your clock reset in between?

yes, clock got restarted and now I will be eligible for ILR (Indefinite leave to remain) in October 2013.

So far I have read for Biritish citizenship of UK for newborn born baby born in UK, I came to know that either of the parents must be british citizen or settled in UK.

My main question is - Can we directly apply for British Citizenship for her when we get our ILR in October 2013 and do not get Indian Passport/Tier1 Dependent Visa till that time?

Is it legal for the child born in UK not to have indian passport/tier 1 dependent visa and directly apply for british citizenship after 10 months of her birth?

yes it is absolutely legal.

remember applying passport is only a choice in our life and in india there are countless without passport.

if your ILR is approved you are in the safe path and can immediately apply MN1 british citizenship registration for your new born baby in oct 2013.
and there is no need to apply indian passport for your baby till oct 2013 if u have no travel plans.

But in the worst case scenario if your ILR gets rejected then u need to remember that registration as indian citizen for new born babies should be done within 1 year of birth.
