HI

I got married in may to my wife in italy however she is not a italian national and holds a Pakistani passport but has the rite to to indefinate stay in italy.

Now i applied for a EEA permit and it got refused because i hvnt worked or lived with her in itlay so that permit does not become valid in my case.

Would u recommend i appeal?because she is 6 months pregnant and am desperate for her to b with me here or what is the alternative application/avenue i can go thru to get her here asap

Pls can someonehelp me im goin mad with worry

What is your nationality?.

It seems like you are a British,based on your post.

If you have not resided and worked with her,then EEA family permit is not an option.

She will need to apply under the immigration rule, and you need to demonstrate you earn 18600 a year and have sufficient accommodation.

Appealing at this point might not be an option.

I didnt realise that i would have to reside in that country in which my wife resides inorder to get the permit think it was a lesson learnt the hard way.

I am a british citizen and income isnt an issue but is ther no other way as she resides within europe and has been for the last 10 yrs??

And what do i have to do to apply under the imigration rule?is ther a particular form i fill in?

You can go to Italy, work there for a while and return with her as a family member of Yours under EU rules.

If you want to use immigration rules, then see the Spouse Settlement Section
