Tier 2 job offer & planning to marry

Post by kcallen » Thu Dec 20, 2012 3:34 pm

Hello, I have not found a posting by someone in my exact situation. I have a job offer that requires a Tier 2 employer sponsored visa, with approximate start date of 1 June 2013. I am also planning to get married in the spring (March-May 2013). I am from the USA, and my girlfriend is Mexican. We both live in Mexico currently (but not living together). Our plan is for me to go thru the Tier 2 process and for her to apply as my dependent once we are married. If I have to go without her at first & have her join me, that would be ok but obviously we prefer to be together. I'm not sure if it matters in these circumstances, but my girlfriend is a dentist (supposedly there's a shortage in UK) and is conversational in English.

Does our situation seem likely to work out positively?

Thanks for your feedback.

There is no fiancee visa for PBS dependants. For her to apply as your dependant she has to be married to you. She can't simply begin work as a dentist without a period of training and it's not permitted for PBS dependants to work as a doctor or dentist in training. If she can complete her training without actually working that would be fine.

Thanks for the response, Lucca. Let me be a little more specific.
1) Is there a waiting period after getting married before applying for her as my dependent on PBS?
2) Do I have to be in UK before adding her as a dependent? Or, Can we do it while still in Mexico? (assuming the response to part 1 is not a factor)

1. No
2. You can apply at the same time from Mexico.

2. note that you can only apply for entry clearance from Mexico if you have a resident permit there:
