Applying for business visa

Post by ra1986 » Fri Dec 21, 2012 5:59 am

Hi,

I was granted student visa and went to study in 2006 and was granted leave to remain further for 2007 and 2008.
I wanted to stay more and so a consultant in north london, adviced me for a tier1 visa, but i didnt had PGD for which he told me that he do some arrangements.
Got my application rejected in end of January 2009 because i used deception. Well yes, indeed it was wrong to do so, anyways, I left the country next week. Got settled in Dubai and now working here in a private firm as a Sales Manager.

I am stressed because 2 days back, my employer asked me to attend a meeting in April with our supplier in Birmingham, he asked me to apply for a business visa (as he himself got one and visit suppliers every year).

I was wondering, since my sister lives there, can I instead of business visa, apply for a family visit visa?

Or I will be rejected in both the visas?
Or is there any chance?

Apply for a business visa as that is what you need for your particular visit. Following the rules and guidance, previous deception in a leave to remain application should not affect a later application for entry clearance unless there has been aggravating circumstances listed under para 320(11). I think you should be fine if you can show a well-established life in your current location and circumstances.

The only advantage with a family-based application is that one gets a right fo appeal, but this is no use to you as it will take six months to get in front of a judge, and that meeting in April will have long passed by that time

Public expense 5year.. n if forcely removed then 10years
I left the next week.

Tks.. well i can skip meeting this time.. dont mind if it takes 6months in family visa. But really afraid of rejection coz if rejected will have more problem the next time.
And in business i will get limited or may be no right of appeal
Keeping this in view.. What do u suggest, to go for family or business visa?

You should apply for a visa that matches the purpose of your visit. You clearly don't understand the purpose of an appeal. It's not a magic wand to wave away problems; it's designed to overturn incorrect decisions. Applying in a family category will not prevent a refusal based on your previous history. You will still be refused and if it's a valid refusal an appeal won't overturn that. You've already been told that your previous history will not affect an application if yo have not aggravated that.

I got it!
will apply after new year for business... tks alot!

One last thing, while I was in London - I had a car accident for which i showed my international driving license, but they said becoz i had provisional license already, international becomes invalid. Later I got UK Driving License.
At the time of trial, the Judge fined me for £700 and restricted 3months driving - but they didn't took any details of my UK driving license nor i got any points. I couldn't pay fine at that time and now its in my credit history.

Do I have to mention all this in Traffic Conviction section of the visa application? Do they check credit history?
