ILR Queries

Hello everyone,

Currently, myself and my wife holding a Tier 1 (General) visa valid until March 2015. I have few queries in my mind for seeking clarification from you.

1. Initially, I came to UK on WP visa 2008 and stayed 2 years and switched to Tier 1 in 2010. Can I apply ILR in 2014 even though I will be completing 5 years continuous living period in UK in Sep 2013 ??

2. What happens, if my Wife can continue Tier 1 (G) visa until visa expires in 2015 and after that what visa category does she needs to apply for visa extension
(OR )
Is my wife need to apply FLR as soon as I got my ILR status ?

3. I’m planning to switch from permanent to contractor in the coming year, checking if there are any gaps in my employment / earnings in last 12 months will it have any impact on my ILR application ?

Are both of you on T1G independently (your wife not as your dependent)?

1. Initially, I came to UK on WP visa 2008 and stayed 2 years and switched to Tier 1 in 2010. Can I apply ILR in 2014 even though I will be completing 5 years continuous living period in UK in Sep 2013 ??

You can apply at any point you complete the required continuious residency period (5 years in your case) in all eligible categories (WP and T1G are eligible categories). But ideally you should have a valid visa at time of your application.

2. What happens, if my Wife can continue Tier 1 (G) visa until visa expires in 2015 and after that what visa category does she needs to apply for visa extension

Assuming she is on her own T1G, when does she complete 5 years?. If she is your dependent, when did she enter UK in dependent category?

For smooth transition, I would retain being permanent, and only switch to whatever after ILR.

Yes, she is Tier 1 G Dependent only. she entered UK this Dec 2012.

Once I get ILR, can she continue as Tier 1 G Dependeat until her visa expires or Does she need to apply FLR ?

Important question I forgot to ask?
When was your wife's T1G Dependent visa applied for? Pre/Post Jul 19-2012?
