Spouse visa refused some advice needed :(

Post by gali1982 » Sat Dec 22, 2012 5:24 am

Hi all,

My husband applied for his spouse visa on the 06/07/12 and it has been refused due to him not providing his English language test certificate which arrived a few days after submitting his application.

I have a few questions which I hope somebody can help me with:-

Firstly what are his chances of getting the decision overturned if we now send the certificate when appealing?

Secondly is it best he appeal from Pakistan or for us to appeal from
the UK? which will be quicker?

Thirdly do we need to send the original English test certificate or will a photocopy suffice?

Chances are good, if this was the only reason for your refusal

You can send appeal from anywhere, but the forms and the hearing will be sent /take place in UK

Thirdly do we need to send the original English test certificate or will a photocopy suffice?

Original only

what is the issue date of the test certificate?

assuming the test certificate was issued "after" the application date - in that instance can it be used /considered as it didn't exist at the time of the application?

Thanks Batleykhan for replying

The issue date on one of the certificates is the 05/07/12 and on the other 20/07/2012

Spoken certificate says 20/07/2012

Written says 05/07/2012
