ILR-Earliest Date to book PEO appointmnt due to late ukentry

Hi,

My Initial HSMP (2 years) visa was stamped in India on 29 Feb 2008 , But i travelled to the UK on 11 March 2008. *(11days after staming).

Subsequently i moved into Tier 1 General after 2 years and the current 3 year Tier 1 Visa is valid till 28 Feb 2013.

I am planning to appear at the Croydon PEO on 01 Feb 2013 for ILR ( based on how i interpreted
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary) and also for convenience , due to the fact that i am changing employment during the period and relocating to a new area.

However after reading some of posts in this forum on similar cases and also http://www.immigrationboards.com/viewtopic.php?t=79378 , i am having doubts on whether the date i have picked would be outside the 28 day qualifying period for ILR and if i my application would be refused with no refund.

Could some one please clarify how the 28 day rule (

However, you must make your application before your current permission to stay in the UK expires." ) woud apply in my case.

You will be fine applying on Feb 1st 2013. I.e. you are eligible to apply upto 28 days before the 5th anniversary from EC, as you entered the UK within 90 days.
