Hi!! Im Canadian and I'm married to American man we didn't apply for I 130 yet just wonder if possible for me to go to the state as a Visitor I94 then when I get to the state my husband can apply the I 130 ? please help and where can I get the I-94 someone told to my husband we just go to the border and they will issue it there is that true ?please help...thanks

I94 is an entry clearance card issued by the US customs to aliens (non-immigrants) entering the USA. For visa-waiver nationals, it's green, for visa nationals, it's white. It has absolutely nothing to do with permanent residency! If you go to the USA as a visitor, they WILL give you one of those on the border/passport check as long as you are allowed into the country.

Non-visa nationals will also get a white card if travelling with a US visa. And Canadians and Bermudians may not get any kind of I94 if admitted for 6 months or less.

Hi!! thanks for the reply so it means I'm allowed to go to the state to visit my husband then?what should I tell to the border if they ask me who Im visiting too should I tell them the truth that Im going to visit my husband or that will give me a red flag?? If I visit him and stay with him can he change my status or I need to go back in canada then apply for I 130 and do the process that way? thanks I really appreciated .
