Tier 2 General Migrant status

Post by Siriram » Wed Dec 26, 2012 8:48 pm

Hi,
I have a question
My friend is a doctor, got Tier 2 General Migrant status in December 2012 initially for 3 years.
Will she be able to get ILR after 5 years ?

Thanks for your reply

same enquiry

Hi. I am new here i this forum.. I have been reading the forum for quite some time and I noticed that you are very knowledgeable and is very helpful to others. Hopefully, you can help me on my enquiry as well. I am currently on Tier2 (General) Visa which I got last July 2010. I am planning to "change employment" next month (Jan 2013) with the same work (Senior Care Support Worker) but for a new company. My question is, Will I still be eligible for ILR in 2015 even if I changed employment. My worry is because of the new UKBA rules that came out last April 2011 re: ILR requirements (i.e. 1 year cooling off period/ 35,000 per annum salary). It is for the sole reason that I will be applying AFTER April 2011 to change my employment so I am worried that this new law will affect my eligibility for settlement on 2015.. Hopefully you can help me on this one. Thank you so much and Happy New Year!

Please check para 66 of the T2 policy guidance regarding the requirements for the skill level and appropriate pay for your new job.

You must have continuous leave in the UK for 5 years, the cooling-off period would only apply if you let your leave lapse and applied for entry clearance from abroad. The £35k salary threshold only kicks in for applications on or after 6 April 2016

My COS had been posted to me already so the skills level and appropriate salary had been sorted out already. I will be applying January 2013 as soon as I manage to book a PEO appointment. I was a bit hesitant to change employment because I thought that my ILR clock will be reset. Anyway, thank you so much for help!
