Confused

Post by G13 » Thu Dec 27, 2012 7:34 pm

I apologize that this question has been asked before but i have a very confusing situation.

I am Northern Irish by birth and have both British and Irish Passports.

My wife is Mexican.

She had a student visa for the UK which was changed to a 2 year spousal visa after we married in 2008.

In 2008 we ended up relocating to USA on a visa for a job opportunity. We have been here since.

We had contemplated moving back to the UK but the summer rule changes make it much harder. However i was informed that due to the fact i am also an Irish Citizen we could apply through that route?

we are either looking to live in Northern Ireland or if we have to for a year living in Ireland. Or even staying in Ireland for three years and then getting citizenship for my wife there.

Does anyone know any more about this Dual Citizenship situation? i read somewhere that i may have to renounce my British Citizenship in order to apply as Irish?

while you are thinking about renouncing your citizenship, you might also want do the surinder singh i.e, go to another EU state with your spouse, work there temporarily and then apply to return to the UK on the basis of the EU law.

That is what the thought was when i mentioned living in Ireland for a year or 6 months. Work and live there and just go up to Northern Ireland to visit Family. If we really liked it however it may be a thought just to stay there and get wife a Irish passport in 3 years, since it will take 5 or more to get British passport now.

The same rule will likely apply in Ireland as you are citizen of both countries, you could however apply under national immigration rules in Ireland, and she would be due for naturalization in 3 years. I do not think the UK will accept your application for surrinder singh as you would have only exercised your rights in Ireland which of course you are a citizen of, I would expect for singh to work you will have to have exercised those rights in other states.
