Hi,

I have a Tier 2 ICT established VISA issued from 12th Aug 2012 to 12th August 2015. I came to UK on 12th Sept 2012 and I am going back on 31st Dec 2012. One of the company in UK has agreed to sponsor me Tier 2 General. Would I be eligible to apply under Tier 2 General from India. Will 12 month cooling off period apply to me. Can any one clarify as I am leaving the country and resigning with current employer.

This is the same question i have been asking for the last 2 weeks but no one seems to know the answer. did u manage to get an answer? manci can you please help us with this question? thx

Nobody is answering because this question has been asked and answered on many similar threads. Cooling off periods apply for those with ICT before a certain time (either April 2011 or 2010, not sure as I am not ICT). 12 months. What is unclear is if this 12 months starts from when you leave the UK or from the expiry of your current visa.

Read the guidance for additional info.

Hi there.. thanks for the response.. the question is if this cooling off period applies even if someone is applying for the visa from home country? and especially on a different visa i.e ICT to General category? please advice..

Use your eyes and look at the sticky at the top of the page.

Yes, the cooling off period applies if you want to change sponsor if you got your visa post April 2010 or post April 2011 in some cases, regardless of where you apply from.
