Self Employed UK Or Overseas?

Self Employed UK Or Overseas?

I manage my company which is in India, while living in UK. I am not registered as self-employed here.

Now on the form:
Country of earnings? India or UK
Accountant from which country? (in guidance it states – if earnings were done while I was in UK it has to be a UK accountant but if they were while outside, it can be an outside acountant)


My problem is:
Wouldn’t selecting UK as the answer to both questions confuse the caseworker into asking for self-employment documents in UK which I don’t have.

You need to be set up for business in the country where you are claiming income and declaring that for tax purposes (whether or not there is any tax payable due to you not being resident for tax in that location) . Obviously that would be dealt with by a local accountant in that country. You will also need to be declaring this income to the tax authorities in the UK, where you will be liable for tax on those sums earned overseas. Whether you pay double taxation on the income depends on what tax treaties or concessions exist between that country and the UK. But you still need to have made official declarations.

Well no, you will not register as self-employed, but you certainly need to register with HMRC. Also your company, consideration as to whether the company will be tax resident in the UK, and if so the company will also need to register with HMRC.

Just because the company was incorporated in India does not mean that other tax jurisdictions will not be interested in the company. The term "my company" ..... your terminology ..... you are the sole shareholder and sole director of your company?

This is probably too complicated for a public board like this, and you really do need to seek professional advice in the UK.
