i am very confused i have been working as a web developer for like 6 months now.. just opened my company and i am ready to apply for the tier 1 entrepreneur visa. But i was reading the policy guidance and it got me very confused that wat i am doing is on NQF LEVEL 4 but UKBA will not consider such activities. as stated in page 7 of policy guidance i.e as following
(iv) are working in an occupation which appears on the list of occupations
skilled to National Qualifications Framework level 4 or above, as stated in
the Codes of Practice in Appendix J of the Immigration Rules and the Codes of Practice for Tier 2 Sponsors published by the UK Border Agency, and youprovide the specified evidence in paragraph 41-SD. “Working” in this context means that the core service your business provides to its customers or clients involves the business delivering a service in an occupation at this level. It excludes any work involved in administration, marketing or website functions for the business.''
It means persons who develop websites or work as a marketing consultant etc can not apply for this visa?? experts opinion is required...

The business must trade at level 4 or above regardless of what title you may apply to your own tasks within the business. Basically, you can't be a minicab company or a corner-shop and then apply a title to your own job description at level 4 or above (call yourself the marketing director or VP in charge of mergers and acquisitions) for that organisation, because the organisation in which you work, or own, or are a director of, is not trading at level 4 or above.

so basically if i am working as a web developer/ web master then its fine bcoz my main activity is creating websites .. so its fine if i use web master tittle bcoz i have everything ready and i was going to submit my application very soon but suddenly this whole thing confused me up.

Hi ALL,
I have similar sort of question here.
I am applying from PSW to Tier 1 Ent (Switch)
I am applying as Ent Team and have registered IT Solution company where main business activity is Website Development and SEO, and also will be providing E Marketing / Marketing Consultancy services too.
I will be working as Web Developer / Designer (SOC CODE: 2131 )
My Team member will be working as Marketing Manager / Consultant. SOC CODE: 1132 )
Both SOC Codes are at NQF level 6.
As per my understanding I am ok as level of business is NQF LEVEL 4 above and occupation is ok too.
but expert please advise

I am really sorry to read your comments in regards to this, As someone who have helped people and answered more than 5k queries on this forum writing that I have to pass as I am not an expert legal advisor (I have never asked a legal advisor to comment I just mention the word experts advise for someone who have dealt with this kind of query before and had experience of it but same time I never mention other not allowed to comments or advice).
Thanks Lucapooka you don't have to answer, advise or comments if you don't want to.
Just because I mention the word expert advise and if you think you are not you would have just passed this post rather than asking for explanation to identify the expert on the forum.
