No accommodation pre spouse application.

Post by Ted » Tue Jan 01, 2013 11:51 am

Ive been searching this site for information on :

If your spouse submits a spouse settlement application and the spouse sponsor has met and exceeds the financial requirement but has not arranged accommodation, will this lead to a refusal?

Would be grateful if someone could clarify this for me. :)

EC-P.1.1. The requirements to be met for entry clearance as a partner are that-
[...]
(d) the applicant must meet all of the requirements of Section E-ECP:
Eligibility for entry clearance as a partner.

[...]

E-ECP.3.4. The applicant must provide evidence that there will be adequate accommodation, without recourse to public funds, for the family, including other family members who are not included in the application but who live in the same household, which the family own or occupy exclusively: accommodation will not be regarded as adequate if-
a. it is, or will be, overcrowded; or
b. it contravenes public health regulations.

Why don't you sort arrangements out with your parents ( if possible) if not rent a place and use the tenancy agreement as evidence that accommodation will be available on arrival of your spouse

Thank you kindly for your prompt replies. I was hoping to buy but my last trip to London I could not find anything that met my criteria, renting is a possibility but I did not want to waste money renting when I was living with the parents.

I dont want to use my parents home as a place, Im not sure they would agree to this.

Im now back overseas and have been for 3 month, and will be for another 6 weeks at least, renting in london can set you back 1'000 per month, money I would rather use for buying rather than renting.
I have been a longterm expat, living outside of the UK for close to 20 years, thats why I dont have accommodation, I can't see how I would qualify for public funds if I have over the permitted amount for you to be able to draw public funds, just seems not sensible to arrange accommodation before application has been approved.

Nevertheless, you will need to show that you have suitable and secure accommodation before submitting the application.
