Thanks JohnJohn wrote:AN is the correct form for him to use, but he needs to check carefully to ensure that applying would not be a total waste of money.
When in 2008 did he get his ILR? He might need to wait and apply after the 5th anniversary of him getting his ILR.
Thanks JohnJohn wrote:Well he certainly will be time-qualified then.
But might he be time-qualified sooner? It is actually quite complicated and unless you are able to post his full UK immigration history, it is unlikely that it will be possible to come to a firm conclusion.
But for starters, you tell us "He came to this country in 2000 and applied for Assylum.". But when did he apply for asylum? As soon as he arrived in the UK, at the Port of Entry?
Or did he arrive in the proverbial back of a lorry, and then claimed asylum later? If so, how much later?
Thanks John,John wrote:OK, he entered the UK in 2000 but did not apply for asylum until May 2001.
My understanding is that he did not become "legal" in the UK until he got his ILR, and therefore he should wait until he has had his ILR for 5 years before applying for Naturalisation.
Thanks John, Much appreciated your very logical approach and for you time.John wrote:Have a look at this UKBA staff guidance document, and 8.7 in particular.
You will see three categories detailed there. Which one do you think he is in? Based upon what you have posted, I think 3.
When he applied for asylum, what did he tell them, as regards when and how he entered the UK?
