ILR for my son

ILR for my son

HI All,

Thank you for taking time to read my query,

I am applying for ILR after completing 5 yrs (HSMP+Tier 1 General) in Feb 2013 so as my wife who qualifies as she has spend all 5 years as a dependent. Our son was born in Dec 2011 (in UK) and I have plans to include in our ILR application since we have some immediate travel plans after getting the ILR (so avoiding registering him as a British national for the time bieng),

As per dependent rules where one has to stay more than 2 years my Son doesnt qualify this criteria. But he is born here. So does that rule applies to him? Or can I apply for him aswell using the Set(O)?

Appreciate advise from all senior and knowledgble members of this forum on this matter,

Qualifying period of 2 years doesnt apply for Minors (under 18) and can apply using the same for as me under dependent,

Just one more query: I am planning to apply 28 days before the current visa expires.

under the section in SET (O) they ask how many years have you lived in UK,since I am applying 28 days beofre my visa expires do I put this as 4 years and 11 months or 5 years?

1. Your UK born son is OK to apply as your dependent.
2. your application date is OK.
3. 4 years 11 months - with a small note in brackets (at time of application). If CW have a problem, they will ask you to amend it, hopefully. But not a big deal.
