I have already written on the following topic and got some important guidance/opinion from a senior member (special thanks to him). Now I would like to request to get 2nd opinion on this matter specially from the other senior members please.
My issue is-"Just two weeks ago I have fulfilled my 10 years long stay in the UK. At present I am in Tier 1 (post study work) visa and will apply very soon for my ILR just after I get my result on the Life in the UK test. But I got confused how can I extend my dependent's visa (My wife and my 10 months old little baby, visa expires end of February 2013 same as mine) They are living with me since End of July 2012. However both My wife and baby's visa was issued (In Bangladesh) before July 2012 but they entered into the UK end of July.
Now I need to confirm whether they fall under the new rule commencing 9th July 2012 which says that I must have to fulfill financial requirements for my dependents. OR Since visa was issued before July 2012 they would be under the old rule where no financial requirements needs to fulfill. I spoke to some lawyers they said that I have to meet financial requirements. Because I am not a citizen nor settled yet although they made their first application as my dependent before July but in order to Leave to remain this will be first application and therefore they do not qualify old rule. For better understanding I have attached a few lines below from the FLR(M) guidence note, section 21(d):
-"You need to meet the financial requirement if you
made your first application to enter or remain here as a
partner after 9th July 2012".
Can anybody please confirm me whether I have to meet financial requirement or not in order to extend their visa just as my dependent?
