ILR Leave

Post by WAQQASBHANGOO » Sat Jan 05, 2013 8:28 pm

Hi Moderator,
Below is my case, may be this is a bit early to ask but i want to plan well for ILR application.

Tier01 G Visa: 19-01-2011
Arrived in Uk : 03-05-2011
Leave from UK: 20-10-2011 till 10-11-2011
Tier 01 Extension:19-01-2013 to 19-01-2016

My question is will i be able to apply for ILR at the end of the extension or do i have to take another extension because i arrived in UK after 90 days of getting the visa.
Can you please answer & guide in easy words?

Thanks in Advance

Afaik, you would need another extension to take you through to 03/05/2011. You can then apply anytime from 8 days before this date.

I have got four dependents, is there a way around it so that i dont have to pay the heft fees twice (extension+ILR) for my dependents.

submit your extension application very close to the visa expiry date, perhaps make a postal application and pay by a cheque.
there is no guarantee but if you are lucky you might receive leave end date 3 years from the approval date!
otherwise, if you get leave to remain upto 19/1/2016, then as per current rules, you'll need another extension. however the rules might change again in future - so keep an eye.

Thanks Guys.
I have already got the extension uptill 19/01/2016. I went through with my solicitor to get this extension, i asked him the same question as my understanding was that i need another extension, but he said i can be eligible to get the ILR & i got confused. Thats why posted this topic.

My question is:
As i might need to pay like more 5K for the another extension wichh will include myself & 4 dependants, is it possible if i dont apply for my dependants extension & they exit the country.
So once i am eligible for ILR which will be May-2016 then i can apply a joint application for myself & dependants. It might save me around 4K.
