Naturalisation 5 years Qualifying Period

Few Questions I didnt found clear answer in forum:

I am in UK for last 7 years, I got ILR in Dec 2012. Residential requirement on UKBA sites says 5 years qualifying period and free of immigration restriction when applying i.e. ILR or PR. It does not say 12 months after ILR.

So as per my case I am in UK more than 5 years, have got ILR, meet all residential requirement as per UKBA therefore does it make sense to apply now or wait for 12 months. If not, does the 12 month period after ILR count towards qualifying period.

Yes it does.
Immigration time restrictions wrote:You must be free from immigration time restrictions when you apply for naturalisation. Unless you are married to or the civil partner of a British citizen, you should have been free from immigration time restrictions during the last 12 months of the residential qualifying period.

as you mention 5 years qualifying, so i assume you are not in spousal route

read the residential requirement carefylly, especially the point that states "free from immigration restrtiction when applying, and ..." ..you'll find your answer.

@ban.s. it says "free of immigration time restrictions during the last 12 months of the 5 year qualifying period" it means 12 months after ILR will be 6 years in Dec 2013. But it also says immigration exemption period does not count towards qualifying period, plz clirify, thanks you

immigration exemptions and free from immigration time restrictions are not the same thing. the former is outside the purview of immigrations e.g. a diplomats stay in the UK (and hence not considered). the latter is an immigration category without any end date restriction i.e. ILR

You have to wait 1 year after your ILR and you can apply in Dec 2013 for your naturalization. Good luck.
