Time limit to apply for Judicial Review

Post by jankk » Sun Jan 06, 2013 7:39 pm

I have heard that the time limit to apply for Judicial review following the refusal to appeal to upper tribunal has been reduced from 3 months to 16 days from the day the upper tribunal refusal notice was sent.

I spoke to solicitor he is saying he is sure its still 3 months. as it says on home office website but justice.gov.uk website says something else.

not sure which one to follow. As they say rule has been changed recently from 12 october 2011 so thats why most solicitor might not be aware of recent change or they might be right.

Could anybody who has the knowledge can throw light on exact time limit. I am recently refused by upper tribunal to appeal to itself my solicitor says its 3 months maximum time but nevertheless i am going to apply for judicial review myself as solicitors are extremely expensive plus i have noticed that not all of them are updated with latest legislation.

Would really appreciate this.

Best wishes
