ccjs not disclosed on form

Post by lostintot » Mon Jan 07, 2013 4:12 am

I applied for naturalisation on the 28th of Nov2012 having obtained ILR in sept,2011 after 10year residency.
My delimma now is that i have just noticed that i have ccjs in previous addresses( i didnt realise untill now that Trustonline doesnt link address!)
My question now is, should i notify the Homeoffice of this development? I obviously didnt state this on my application since i didnt know.

There are 4 CCJs dated 2 in 2009, 2008 and 2007.

Will i be banned for 10 years for not disclosing- not like i know
Please note that I obtained the ILR having this unknown CCJs
Thank you

I would say that you immediately disclose it by writing to UKBA at the correct address.

If they find out, then they might put a 10 year bar.

Dont be rediculous asim 72. lostintot didnt lie or manipulate when he applied for his ILR and also when he applied for his naturalisation.

And also for the simple fact that UKBA would have checked his Civil Judgement records when he applied for his ILR and they will check it again for his natrualisation application. If they think his CCJ's are serious enough then they will refuse his application. If not, then they will issue him citizenship.

Hi

@ Lostintot.. Unlikely you will get 10 years Bar.

If it was serious they would have taken into account on granting ILR.

I think its good idea to write them a letter saying oversight had occured and send it by registered post and keep the evidence.

Also, keep the Trust online report as well , in case if you need to show them that you were Proactive and honest in your dealing.

By the way .....How did you come to know you have CCJs ? I mean what method did you use ?

I thought Trust online will be good that is what they say on their website.

You also need to clear your CCJ's...i.e pay them if you haven't already done so.

Thank you guys,
i was all the while checking the Trust online and not the CA cos i felt it was a waste of money( now i know better!) more so because CCJs are what the UKBA actually go for. But i only just found out this week that Trustonline dont link addresses, that is, i have to check every single address i have lived.

I got ILR without knowing there were CCJs, again, just checking current address on Trust Online.

I shall be calling the CC to find out which organisation the CCJs were about cos they were between 2007-2009 and i clearly dont have a clue and if they are actually mine and not my Ex's. Hopefully will sort someting out ASAP!

I have sent UKBA an email as well stating my error and omission hopefully i will get a reply

If they are your ccj's then they are your ccj's. How can your ccj be your ex's?

Or do you have identical name, DOB, sex, bank account number of your ex?

Email is not good enough, and what reply do you want from UKBA?

You did not provide (for whatever reasons best known to you) the information which you were supposed to provide to UKBA. Now you should write a letter to them and disclose what you did not before.

Write a letter means, writing a letter using a pen and paper, or type a letter, or print it on a printer and date and sign it, and then send it to the address where UKBA asks you to send it. Look at the form or guidance or UKBA website to find what that address is.
