Student Working During Application for Visa

Post by niomi » Mon Jan 07, 2013 3:48 pm

I was allowed to work full time as of Sept 30, 2012, which was when my masters programme ended.

On January 31 my Tier 4 visa expires.

Since I am awaiting the results of another visa application, am I allowed to work full time in the interim?

I called the Border Agency twice: once they said I cannot work at all; once they said I can only work part time.

Does anyone what the rules are in this case? I know I must remain in the country and my visa status is frozen, but what are my working rights after Jan 31?

You continue to be bound by the same terms/conditions until a decision is made on your pending application.
Please do not send me PM if I haven't sent you one yet.

Thanks for the reply.

According to the border agency, I can only work part-time after January 31 because my permission to work is only meant to be for 4 months after the completion of my studies.

According to the BA, this was a separate condition from my visa itself....

which means since 4 months will have elapsed after January 31, I can't work full-time anymore -- only part time.

Does this make sense?

To me it seems like my visa states that I am allowed to work full-time when NOT in term time, and that because of this I should be allowed to work full-time after January 31.. :?:

I tried UKBA again and they informed me that my working rights will be the same as if during my studies (I was on a Tier 4 visa before).

It's a bit ridiculous since this means I have to follow my former school schedule and can only work part time -- even though I've completed my studies... :?

Sorry, I'm just so confused. This site says that I CAN work:

http://www.workpermit.com/news/2012-04- ... rights.htm

'If your course is completed and you have applied to remain in the UK under another visa in the points-based system, before your existing permission to stay expires, you are allowed to work full-time until your application is decided.'
