ILR - Query regarding absences from the UK (Tier 2 ICT-G)

ILR - Query regarding absences from the UK while moving Tier 2 (ICT) to Tier 2 G from new company/sponsor.

1. My first visa is Work permit start from 22/11/2007 to 22/11/2009
2. And extended my work permit in UK to Tier 2 (ICT) start from 09/12/2009 to 06/12/2011
3. Went to my home country 05/12/2011 and Applied Tier2 G in India on 25/01/2012 with other company (thru new company -with in 60days period only from 06/12/2012 )
4. UKBA Refused the application from due to funds problems for my Dependants maintenance .
5.Re- applied on 08/02/2012 and again UKBA refused due to old CoS
6.Reapplied again and got the Tier-2 visa on 25/02/2012 and came to UK on 04/03/2012.

Can you please let me know whether i am eligible to apply for my ILR as i have applied my Tier2 G with in 60days only thru my new company from outside UK?)

What was the situation between 22/11/09 and 9/12/09?

Is there a gap of more than 28 days between 6/12/2011 and 25/1/2012? If yes, your ILR eligibility clock has reset here once.

The 60 day rule applies if you were applying for 'further leave' which is issued in-country. The scenario is you lose your job, and within 60 days you are applying for extension under new employer, but during this time you do not leave UK.

In you case, the clock has effectively reset to 4/3/2012 as rules stand today

as per rule ,I have to apply my new visa ( old work permit to new Tier2 General theu new employeer) from home country only that's y i left UK and applied from outside UK.

I have applied for new employeer in Job centreplus when i was in UK only .

Few solicitors are telling that i am eligible to apply for my ILR as per with in 60 days rule ..


Please advise what i have to do whether i can apply or not.
