I have been in the UK for the last nine years. Was in Uni until i failed my exams on a technicality. Im currently going through the appeal process. I was living with my partner since Feb 2011. I was not included in the rental agreement but have a letter from the council offices showing that i was exempt from paying council tax as was a full time student dating back Feb 2011. Had to return to my country whilst the appeal process is on going. My partner and i want to apply for a visa as unmarried couple so that i can finish my uni elsewhere if the appeal doesn't go my way.My partner was paying for everything and at the time did not feel the need to have the bills in both our names.I was advised to go home and wait till Feb to apply. He was paying my school fees as well.We have not got any bills that are under my name.How can i prove that we have been living together ? Went back to my country in Nov. He will be visiting in Jan.Please advice

To qualify for the unmarried partner visa you need to have lived together in a relationship akin to marriage for a continuous two year period. Given that you’re currently residing in your home country and prior to this you lived together for less than two years, I’m not sure you meet this requirement.

anniecc is right. You don't meet the requirement. The 2 year co-habitation period in a relationship 'akin to marriage' is mandatory.

Thought there was a clause, {still trying to find it as cant get hold of my lawyer} where it states that if you have to be apart for a reasonable period of time because circumstances dictate, which in our case ,will be because of the appeal, two months apart, then its OK .Reason being that my appeal has to be outside the country .My visa was valid till 2014 , did not want to breached any immigration laws so i am appealing from home.

UKBA do accept short periods apart, provided the two year cohabitation requirement is subsequently met. So for example, a couple live together for 12 months, are apart for three, then together for a further nine. To me your situation is different because the period apart means that you haven't fulfilled the two year requirement. The requirement would only be met once you had (legally) returned to the UK and resumed living together.

Also bear in mind that the test is two years cohabitation in a relationship akin to marriage, so your partner visiting you when you're living apart doesn't count.

anniecc is correct. You would be applying before the 2 year mandatory term has been met.
