ILR Application (Tier1) When to Apply?

Dear all,

I apologize in advance if this is a repetition, as I did search through the existing topics but could not find a specific answer to my question.

Basically, my date of entry in UK is 40 days later than my date of visa stamp (HSMP at that time - later converted to Tier 1).

My current visa expires on 9th of march 2013, when I will be 40 days short of residential period of 5 years. However, I read on the forums and UKBA website that a period of upto 3 months ibetween the date of entry and date of stamp is counted towards residential period.

My question is, if I apply on 20th of February (using PEO), will that be ok? as that is 20 days before my visa expiry (plus 40 days initial delay making it 60). Will that affect my application, or should I try to get a PEO appointment as close to 9th of March as possible?

I am just concerned, as I just might not be able to get an appointment, so want to grab the first one I get.

Any help will be appreciated.

1. In your case, you begin your 5 yr count from stamp date.
2. If that 5 yr falls on the expiry of your current visa, you are fine.
3. You can apply during the last 28 days of your 5 yr period.
4. Your PEO date is fine, assuming all above stand true.
