I will be grateful if someone can either answer my questions or can point me towards the answers / discussions (if already given anywhere in this forum).

I am a UK citizen, very professional living in UK with an overseas girl (Indian Passport holder). She has had a spouse visa for about 1.5 years and around July 2013, she will be eligible to apply for ILR (in about 6 months).

However, the issue is that we are really not getting along and our marriage may break sometime in 2013. The elders are trying to resolve the differences but the issues may or may not be resolved.

Therefore, to avoid complex divorce proceedings in the UK, I would like to postpone / delay her ILR application from July 2013 to at least a couple of years when we have more visibility over our future.

Has anyone encountered such a case before? Any suitable advice on how her ILR can be delayed will be most appreciated!

Thank you in advance for your time!

Regards,

Yaswind
Think of this way, once she's eligible for ILR (After living a couple of years with you) she has earned our right to apply for ILR. Why would you even care if she lives here or not once you are not together.

I'm not sure if you know that but Karma does bite the arse real bad. (:
Goodluck.

You cannot postpone or delay the law. I'm assuming you are talking about ILR eligibility instead of ILR application.

Also, you are implying that the future of your wife's immigration status in the UK should be dependent on your relationship - this is not how it should work and you need to have a really serious look at your relationship. The mere fact that you are trying to influence this until you've decided about your future is not good - you can't hold someone hostage over this. You should make decisions about your relationship completely in isolation of your wife's immigration status.
