Does Child require ILR for citizenship under section 1(3)

Post by manoharlinux » Thu Jan 10, 2013 10:08 pm

Can someone with knowledge of child citizenship answer my query? If the way described below ( without ILR ) is fine I can save few hundreds of pounds.

My daughter had born in UK while I had Tier 1 General visa. Immediately after 15 days of her birth I got my ILR. I was not able to include her in this ILR application. Now she is two months + and has UK birth certificate

My query is can I apply for my Daughter citizenship as per section 1(3) without having Indian passport and UK ILR. This will save me couple of quid’s.

Also, please advice on forms to use, Is MN1 is correct form to use. Sorry if it’s obvious and I being stupid but Is this link still valid, I am asking this because on NM1 form’s 1.3 query asks for ILR date. So , in general is there any good guide (apart from home office site) which explains what to fill in MN1 for section 1(3) application.Again I also need to know if my Bio-metric card and child birth certificate is sufficient for application.

See Q1 & Q3 in Citizenship FAQs - Common Questions - Read before posting - Children.

BTW - 1.3 asks "if & when". If not relevant, leave blank.

Thanks for posting FAQ and Links

one final query reg Parent's passport. My passport is with homeoffice in support of my wife's application for ILR, I do have my Bio-metric ILR card. so, do you guys think Father ILR bio-metric card is sufficient for application.

Really appreciate and thanks for your speedy earlier reply's guys.

Jambo and wpilr_nov12 Please correct me.

Based my situation of not having passports with me (explained in previous post) I am considering to waiting till i have them in hand and apply for my daughter citizenship using form MN1.

Is there any legal time limit , as baby do not have any documents except birth certificate..

Yes! The MN1 application must be made before the 18th birthday!

In other words, now, there is absolutely no problem the application being delayed by a few weeks or months.

just made MN1 application today

Post by manoharlinux » Tue Jul 09, 2013 2:17 pm

To continue from where I left..I got my passports back with request for return of partners document made on wife's application. I then went on with MN1 application today using Bristol NCS.

I got two of my friends with British passport to sign as reference.

counselor was only interested in my ILR card and babies full certificate. she reluctantly took marriage certificate, wife's Home office reference letters and covering letter on my enquiry.

Guess I now have to wait for 2 months.. :(

This is because none of this is relevant to the application.
