Can we apply FLR(M) for spouse while apply ILR for main appl

Hi,

Please can anyone advise me on this.

I am the main applicant on Tier 1 general visa, would apply ILR this month. However my wife is not eligible for apply ILR since the duration of stay is less than 2 years.

In that case, can we both apply at the same time in PEO for apply ILR as well FLR(M) on the same day. Or do i have wait until i get the ILR,then go for FLR(M). Currently i have booked 2 separate appointments at PEO for both on the same day.

Anyone advise on this.

Does your wife have enough validity on her current visa to complete the required 2 year residency period? If yes, and if she is not travelling out of UK until then, she can wait on her current T1 Dependent visa, and apply for ILR when she is eligible.

Otherwise, she can extend her T1 Dependent visa using PBS Dependent form, which is more straightforward than FLR(M).

Thanks for the advise.

the current visa is going to expired in March'13 and i ( main applicant on Tier 1 Genera) would go for ILR end of this month. since she is not eligible for ILR at this time and Tier 1 dependent visa also expired in March ' 13, that is a reason i thought to apply on the same day, the day i go for ILR and submit her FLR(M) application along with my SET(o).

My question here - Are the case worker would take both of the application at the same time, or do i have to wait until my application is processed for ILR ?

Please advise.

In the policy guidance for pbs (lastest version for all applications after 13/12/12)- your partner/spouse will need to apply on the tier1 dependant application form if she isnt eligible for indefinate at the same time as you- this is quoted on eligibility criteria point 2-

on your second point, yes she can apply same time as you as long as its within the 28days but you will need 2 appointments that day if you going together- one for her and one for you as you both using different forms hence they will be looked at separately, if she was on the same application then you would both go to the same case worker.
