ILR eligibility

Hi All,

Am I eligible for ILR or not? My case is simple but still need clarification.

Date of HSMP VISA stamped in India - 03-03-2008
Date of Arrival in UK - 31-05-2008 89 days later :evil:
Current Visa expiring on - 03-03-2013
Absences including the 89 days in the past 5 years is 138 days.

Am I eligible for ILR? If so when can apply by latest?

Latest will be 3/3/2013 and earliest is 28 days prior to 3/3/2013

I agree with uksettlement .... 28 days prior to 03/03/2013.

Thanks to everyone.
Now I need to get a PEO appointment as I am wary about making an postal application. Getting appointment seems to be a hard nut to crack. Will keep you posted on how I get on with it.
