Switching from Tier1 general(dependent) to Tier1 entrepreneu

Switching from Tier1 general(dependent) to Tier1 entrepreneu

I am currently holding Tier1( general) dependent visa . Can I switch to Tier1 (Entrepreneur) on my next Tier1 extension inside UK.
It is not clear in Tier1 Entrepreneur Guidance as below .It is only mentioned main applicant



Eligibility to apply in the UK
21.You are allowed to make an initial application in the UK (including switching from one
immigration category to another) if you are here with permission to stay as:
• a highly skilled migrant; • a Tier 1 (General) migrant;
• a Tier 1 (Entrepreneur) migrant; • a Tier 1 (Investor) migrant;
• a Tier 1 (Post-Study Work) migrant; • a Tier 1 (Graduate Entrepreneur)
migrant
• a Businessperson; • an Innovator;
• a Work Permit holder; • a Writer, Composer or Artist;
• a Self employed Lawyer; • a participant in the International
Graduates Scheme (or its predecessor, the
Science & Engineering Graduate Scheme);
• an Investor; • a participant in the Fresh Talent: Working in
Scotland Scheme;
• a Tier 2 migrant; • a Prospective Entrepreneur.

I am wondering if you ever got a reply to your query. I am in the UK on a Tier 2 ICT and my wife with me as dependant on the same visa. We are now looking for my wife to shift into Tier 1 Entrepreneur ( main ) however not sure if this switch is allowed whilst remaining in the UK . Like you said the UKBA guidelines only state that you can apply to switch in the UK if you have previously been granted leave as Tier 2 . It doesn't say if this Tier 2 is only restricted to main applicant.

dependent of any category cannot switch within uk, he or she needs to go back home to do that.

@entrepreneur123, point of correction, tier4 dependant can switch to employer sponsored visa inside UK. Correct me if am wrong. Thanks.

not sure about that, but can easily be checked from employer sponsored visa application i suppose.

Yes, dependants can switch to tier2 visa as its clearly stated on the "who can switch" section. I dont understand why HO only included dependant switching for only tier2 visa as there is basically no difference if you wish to switch to other categories. Mayb they will include it later as it makes absolutely no sense to only allow switching in just one category.

also read this interesting text on some socilitor website, i did not aware of this;

Following changes in the Immigration Rules implemented from 1 October 2013, it is now possible to switch into PBS Dependant of Tier 1 Entrepreneur Migrant from inside the UK unless:
■you were last granted leave to enter or remain as a visitor; or
■you are on temporary admission or temporary release.

From the above, it is clear that anyone who is not in the UK on a visitor visa or an overstayer in the UK can switch into PBS Dependant of Tier 1 Entrepreneur Migrant from inside the UK.

In order to apply for leave to remain as the child of a PBS migrant, the child must be under the age of 18 on the date of application. Where the child is aged 18 or over he/she must have, or have last been granted, leave as the family member of a PBS migrant or someone applying at the same time for leave as a PBS migrant.
