zero hour contract and spouse visa

My partner is working on zero hour contarct and his salary is variable

he did earned over £18600 over the past 12 months
i m indian natioanl in uk on work permit but changed jobs recently hence not with my employer for 6 months. My stay is expiring in feb 2013 so i hav to sort things out before that

we want to apply for spouse visa

we r worried if we r eligible based on his employment contract

he is with same employer on zero hour contract from 3 years now

please advice i m loosing sleep over this, i do not want to leave him :( :(

Please be assured that the employment contract won't be relevant... in fact, when you make your application don't even mention it (but do include it).

Even someone with a 40 hour contract cannot know if their employer might go out of business next week, and more importantly, neither can UKBA know. If your partner has been employed for 3 years and is currently meeting the financial requirement then that's what is relevant.
