Foreign Divorce Recognized in Ireland ?

Post by zafarzafar80 » Sun Jan 13, 2013 5:33 pm

Hi All,

Just a quick question if some one could answer me please. I tried to find the solution over the internet but getting very mixed answers.

If a person is married in Ireland and divorced in another EU country, lets suppose Poland. If i want to re-marry again would my polish divorced be acceptable In Ireland ? (Please note the DOJ have recognized it as valid) but my question is in relation to be re-married.

Is there any kind of equalency do i need to apply for in Ireland ? OR Do i need to go to court again in Ireland to make it recognized in terms of Irish law ?

Your help would be greatly appreciated & thanks in advance

Your EU divorce would be automatically recognized as valid in Ireland if either of the party are domiciled in the jurisdiction where the the divorce had been issued.

The rules regarding the recognition of foreign divorces under Irish law are complex and it is advised that specific enquiries in that regard be addressed to the Marriages Unit of the General Register Office at 090-6632945/6/7/8/9 or 6632970 through our website www.groireland.ie.

I don't think you need have the expense of going to court - just send the details to the GRO and they will let you know if the divorce is valid. Their address is
Registrar-General of Marriages, General Register Office, Government Offices, Convent Road, Roscommon

No I definitely don't work there. I just had reason to look up their rules for a friend, so I am quite familiar with them.

Hi Brigid, thanks for the reply. A friend of mine sent a letter to the marriage office here in Dublin and to Rose common and he got a letter back from the GRO that the GRO office is not in position to decide where the foreign divorce is valid or not in ireland until you are ready to get married again. So when you are ready to be married again go with your future wife and submit the documents again. this is ridiculous.
