TIER 1 2ND EXTENSION

TIER 1 2ND EXTENSION

Hello guys,
Due to court fine in a traffic offence I am planning to apply for 2ND EXTENSION of TIER 1 General in couple of months.
I was just wondering that I am eligible to apply for 2nd extension with court fine? Under General ground of refusal I did not find 24 months rule for extension but it is for ILR....

Please comment on it as I am too much worried due to this condition.

Hi Fellows,
I got SAR and disclosure scotland I found my Court Fine and 6 points on my license overthere. I got this fine on May 2012 and my visa run out in June 2013.

Guru and Moderators guide me whether i can apply for TIER 1 extension?

yes you can, you have to mention and attach the court decision.

Hi, mate, I am on the same boat with you.
I think extension should be OK.
The 24 months time frame is applied to ILR only.

Hi Guys,
I got reply from Settlement team of UKBA which says that:

Thank you for your e-mail. I am unable to provide advice on individual circumstances, but the guidance on criminal convictions can be found on our website:
http://www.ukba.homeoffice.gov.uk/sitec ... -refusing/

A fine is considered to be a non-custodial sentence which forms part of the person’s criminal record. If a person has a fine (regardless of the size and/or amount they were fined) within the relevant timeframe, a caseworker will:
- refuse the application (where mandatory), or
- consider refusing the application (where discretionary).

For Leave to Remain applications, the refusal will be discretionary and will depend on the factors outlines within the attached guidance.

Please comment on it...

So whats the final word on this? Have you all been able to get your ext with your conviction? Does the 24 month rule apply only to ILR?
