Switching from PSW to tier-2.... Please help

Hi,

I have a post study work visa which expires on 5th Feb 2013, In about 2-3 weeks.
I was working in Canada and recently came back to UK for a interview.
The interview was successful and the company offered me a job with £24,000 as salary. The company has licence and available CoS also.

But I have some doubts whether my application will be successful or not. Below are the reasons. I would really appreciate it if somebody can help me with these doubts.

1) My salary is is lower than what is suggested in the SOC. The rated salary for design engineer post is around 27,000. If my salary stays the same, what are the chances of my application being successful or rejected?
2) Since,I came back to UK recently I did not keep the maintenance fund of £900 for 3 months. But do post study workers have to show the maintenance funds? I read that work permit holders are exempt from showing the maintenance funds. Is PSW not a work permit? Also what options do i have to solve this issue.
3) I haven't worked for this company before. So no 6 month employment.
I am not sure whether the six month employment rule is still in place. Please let me know what is the situation with this rule.

I request anybody on this board who has knowledge about these issues to help me. I would really appreciate it.

1.) Your application would be rejected.
2.) Your employer can shout for maintenance when they apply for your CoS. They would just tick a box saying they will cover your maintenance.
3.) That requirement was removed and would not impede your application.

I think I will have to convince the company to increase my salary. Easier said than done though.

I also noticed that the salary for new graduates in the code that applies to me is £23.000. I have no experience of working in the UK since I graduated in 2010 (UK) but I have worked in Canada since graduating. So this being my first job in UK will it qualify as a graduate job.

Lot of wishful thinking there but have to ask. Also please can you let me know if you have any idea whether there is any other way around it
(Legal of course). Like changing the job description, etc,etc...
