Applying for EEA4 after divorce, need advice on Section 3

Post by ZenMekanik » Wed Jan 16, 2013 9:40 pm

Hi Folks,

Married (4.5 years) and got divorced. I lived in the UK more than 5 years.I'm now going thru the EEA4 form and:

SECTION 3 – YOUR EEA NATIONAL FAMILY MEMBER

bit confuses me a lot.

As far as I understand, partners considered family members until Decree Absolute is passed. So my ex is no longer my family member. Do I skip this part and jump to SECTION 4 – RETAINED RIGHT OF RESIDENCE IN THE UK?

I don't even know her phone number, address anymore :(

Id appreciate your advices

Was your partner working in the Uk prior to the divorce, and can you prove this.

Are you able to show that through out the time prior to the divorce, your spouse was Exercising treaty rights in any capacity.

Thank you!

All i got her (business related) email conversations, She paid my course fees with her card (i have the receipt), Tenancy agreements, loan payment receipts, On the divorce application she states her job, Linkedin account with all employment history. She has got a business website, thats all i got. there is no way for me to obtain more info.

When we applied for EEA2 they obtained these documents already, so they have them in their archives. why and under what logic they expect me to gather these documentation from a person who doesnt want to see me or contact me any longer?

Again, my ex is "no longer my family member". Do I skip this part and jump to SECTION 4 – RETAINED RIGHT OF RESIDENCE IN THE UK?

Many thanks

You are in a bit of a situation then. You might have a bit of a fight with UKBA.

Thanks guys,

So Ill provide whatever i can but im still confused about the section 3.

my ex is no longer my family member, do you guys think should i leave the sec3 just as it is and explain the situation in a statement?

This bit is not clear in this application at all.

If i had enough money id definitely see a legal advisor, but i cant :(

Yes you have to do section 3, irrespective of whether or not you are a former family member.

Also do section 4.

I did reply to the PM you sent. Probably you missed it.
