"Grounds on which leave to remain and variation of leave to enter or remain in the United Kingdom should normally be refused

(2) the making of false representations or the failure to disclose any material fact for the purpose of obtaining leave to enter or a previous variation of leave or in order to obtain documents from the Secretary of State or a third party required in support of the application for leave to enter or a previous variation of leave".
3) failure to comply with any conditions attached to the grant of leave to enter or remain;.

Hi Gurus,

just wondering if anyone could share their knowledge of this ukba guideline.I did made false representation when applying for leave to enter uk in my country uk embassy 10years ago.but i am a born again now and just wondering if it may affect me during the consideration for my eea2 application.Although,i have replaced my passport to a biometric which i hope will give me a new beginning.

Your immigration history normally does not play a role in applications under the EEA Regulations.
If you meet all the requirements, I expect your application to be successful.

Do not be surprised if UKBA knows about your past immigration history. And do not lie to them!

But in general, if you are legitimately married to an EU citizen, you have to have committed a very serious offence and be an ongoing threat to be excluded from the UK.

Thanks Directive 2004/38/EC,i can assure i am married legitimately to a Eu citizen and i have not committed any offence.its just that i made some silly claims to support my visa application 10 years ago which are untrue and was unnecessary.Hopefully it will not come back to hunt me.Thanks anyway for the response and reassurance.
