Hi all i hope someone can help me.

my partner came to the uk in 1999 from a none eu country as a visitor then applied to stay as a student on time everytime. In 2005 she moved schools she/the school were unaware that this was a state school and therefore she was not supposed to attend this school on a student visa. HO did not let her know of this until she received a refused application by then she had nearly finished her studies. She appealed and each time they required more information until they said an appeal hearing will be held and more information would be sent. She did not hear anything after this and did not attempt to chase as she was young and naive. basically communication was lost between both parties. we have been together since 2003 and have lived together for four years we have been married for nearly a year and all her family are here. i obviously know that we need legal advise but just wanted to see if anyone had been in a similar situation and what had been the outcome. i earn enough to support the application i know amount has to be 18600.

i am hoping to just get an idea of what we can do which application form and will this be straight forward or very complicated etc. Thank you in advance. by the way we have no kids yet.

I take it she does not have any leave at present, and there are no kids?

If you are married and can show that the marriage is honest and you also are able to meet the new rules ie your earnings meet the financial criteria, your spouse can return to their place of origin and make an application for a spouse settlement visa.

Im sure that the previous history wont matter as long as its a legitimate marriage. :wink:

Someone please help. I am writing on behalf of my friend back use she need some advice and can't write in English very well.

Basically she has been married for two years and Divorced recently. She is getting married to a guy on tier 1 hsmp visa and soon planning to change as a dependant ..

She has got two queries one, if she apply for a dependant visa will her previous marriage story will come in to place?

Or will it be like a brand new application and marriage. .will there be any questions while entering uk in the immigration about previous marriage ..pls help
