Just a quick question ...

Will a Zambrano application be returned as invalid if the non-eea applicant do not include his own passport ?

Not at all, not submitting a passport does not invalidate your application under EU law passport with application is not compulsory :)

Progeny, in theory what you say is correct. However, in practice the UKBA may well return the application if there is no valid reason for the passport not being provided.

I concur. UKBA will need to Act in accordance with the Regulation 29A Which may result in them accepting or rejecting application. However they will need to show they have acted in accordance with that regulation. It is difficult to reconcile that with not accepting an application as invalid.

Has anyone seen an instance of where the UKBA accepted or rejected an application (with the passport NOT included) ??
