Spouce visa refusal

Hi everybody, I was refused spouce visa. Could you please tell me wheather.I an eligible to apply for student visa?

That would depend on the reason for the previous refusal. If you were refused on general grounds or suitability (normally associated with a poor immigration history or illegal activity), any new application for a student visa would be met by the same barriers. Otherwise, the Tier 4 application is points-based, and if you score the points, you get the visa.

Whilst tier 4 is points based the ECO is obliged to consider whether the applicant is a genuine student. If you have just been refused a spouse visa they may doubt that you are genuinely intending on studying.

Thanks a lot for your responce. I was refused on financial grounds, and I wondered.how real are my chances of applying for Tier 4

As stated, it's a points-based application but I do concede to the comments of Greenie with regard to the genuine nature of your intentions. If it were an English course or something below degree level, you might well struggle to make a convincing case. If you are a genuine prospective student, you score points you get the visa. I don't know how you intend to score points so I can't make guesses on the chance of approval.

So, you applied to live with your partner in the UK but were refused because you couldn't meet the financial requirements, and are now going to attempt to enter the same country where your partner lives just for study purposes?

The ECO will not be satisfied that intend to return to your country afterwards. Visa will be refused unfortunately.

Your best option is to meet the financial requirement and then reapply for a spouse visa.

Thank u for the advice, I m afraid you are right, they will refuse again.
